DEFECTIVE PRODUCT - Garage


Twelve years ago, I purchased a Tuff
Shed, Incorporated garage which was
to be installed in Mendocino County,
California. There was a one year delay
because the corporation was based in
Colorado and did not comprehend that

only a California civil engineer could
provide the engineering specifications
for a garage. Essentially, the garage
provided by Tuff Shed , Incorporated,
is composed of the framing, siding,
and roofing. I had to hire third party
contractors for the concrete foundation
and the concrete footing, and for the
electrical work, the garage door
opener, the insullation, the sheetrock
for the interior, and all other labor
and materials. I also had to paint
the garage immediately after it was
installed. Tuff Shed, Incorporated,
only provided me a formal warranty after
its portion of the required work was
completed. In California, a product
is warranted for the life expectancy of
the product, not the manufacturer's
warranty. Soon after the garage was
completed, the top roof edge of the
garage's asphalt shingles had to be
replaced. They were defective. I paid
for that cost. Then the siding began
to pull off the studs on two sides of
the garage. Tuff Shed, Incorporated,
replaced this siding, at its expense.
But the siding is pulling off once
again. I offered to pay the $400.00
for the siding and $300.00 for the
materials, but the local branch

representative has represented he would
not come out to do the work. If I use
a third party contractor, my life
expectancy warranty could be tarnished.
I made a formal contact with the
owner of the company, in writing, to
Tom Saurey, the chief executive

officer, president and owner, at
1777 South Harrison Street, Suite 600,
Denver, Colorado, 80210; with a
telephone number of 1 (303) 753-8833.
He has not responded. I intend to file
a civil complaint in the Superior
Court of California, in and for
Mendocino County, Ukiah Main Branch,
case number SCUK CVG 13-__________.
The complaint will seek redress for all
of my injuries, whether the defendant
would have known of them or not. This
includes breach of contract, breach of
implied covenant of good faith and
fair dealing, fraud, unfair competition
pursuant to California Business and
Professions Code, section 17200, et

seq., negligent infliction of emotional distress, intentional infliction of emotional distress, and for injunctive relief. Allowing this defendant thirty days to respond and failing to attempt
to mitigate the conflict, I am also
entitled to attorneys fees pursuant to
California Civil Code. I am also
entitled to re-coup my costs for the
filing fee of $435.00, and for the
service fee of $65.00 to service its
California agent of service as
represented on the California Secretary
of State's online business search for
corporations.
This matter could go on for five years,
and I intend to seek redress for my
time and effort in pursuit of a legal
remedy and for emotional distress in
anticipation of legal proceedings.
Previously, I had to sue Fleetwood
Homes, Incorporated, for the extrinsic
damage caused by its defective siding
and against the manfactuer of that
siding. Fleetwood Homes, Incorporated
eventually filed for bankrupty

protection, and the manufacturer of the
siding, just for the extrinsic damage
ended up paying 92 million dollars from
a class action lawsuit which evolved
from my one plaintiff complaint.
Home Depot, Incorporated is now an

agent for Tuff Shed, Incorporated.
This is a red flag for this agent.
